Introduction and Acceptance of Terms

Welcome to AI Fruit, an AI-powered video generation platform for creating fruit-themed videos. These Terms of Service form an agreement between you and HACK THINKING LAB LTD. By accessing or using our service at aifruit.app, you agree to be bound by these Terms. If you do not agree, please do not use the service.

AI Fruit is owned and operated by HACK THINKING LAB LTD, a private limited company registered in England and Wales under company number 16328697.

Use of the Service

AI Fruit provides users with AI video generation tools to create fruit-themed ASMR, mukbang, and other creative video content. You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations.

User Accounts and Registration

  1. Account Creation: To access video generation and other features, you need to create an account. You must provide accurate and complete information during the registration process.

  2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  3. User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

AI-Generated Content and Ownership

  1. Your Content: You retain ownership of the prompts, reference images, and other inputs you provide to AI Fruit.

  2. Generated Videos: You may use generated videos subject to these Terms, the selected model provider's rules, applicable law, and any rights or permissions required for your inputs. AI Fruit does not grant rights that belong to a model provider or third party.

  3. Usage Rights by Plan:

    • Free trial: Generated videos may include a watermark.
    • Creator and Pro plans: Generated videos are watermark-free. Commercial use remains subject to the selected model's provider rules, these Terms, and applicable law.

  4. Attribution: AI Fruit does not separately require a credit line for the platform. A selected model provider, source asset license, or applicable law may impose different attribution or disclosure requirements, which remain your responsibility.

Credits and Subscriptions

  1. Credit System: Video generation consumes credits based on the model and settings used. Credit costs vary by model and resolution.

  2. Subscription Plans: We offer monthly and annual subscription plans with different credit allocations and feature access.

  3. Credit Expiration: Credits expire at the end of your billing period and do not roll over unless otherwise specified in your plan.

  4. Refund Policy: All purchases are final and non-refundable unless otherwise required by law. If you experience technical issues that prevent video generation, please contact support.

Prohibited Activities

You agree not to engage in any of the following prohibited activities while using AI Fruit:

  • Generating or attempting to generate content that is illegal, harmful, threatening, abusive, or violates the rights of others
  • Generating or attempting to generate sexual or nude content of minors, CSAM, or any content that exploits or harms minors in any way — this is a zero-tolerance violation and may be reported to law enforcement
  • Generating sexually explicit content (NSFW), non-consensual intimate imagery, or content that sexualizes real people without consent
  • Generating graphic violence, hate speech, harassment, or content that promotes harm to people or animals
  • Attempting to bypass our content safety systems (obfuscated prompts, alternate spellings, or indirect phrasing)
  • Generating content that infringes on intellectual property rights of third parties
  • Attempting to reverse-engineer, decompile, or extract the AI models used by our service
  • Using automated tools to abuse the service or circumvent usage limits
  • Reselling or redistributing access to AI Fruit without authorization
  • Interfering with or disrupting the security or performance of the service

Content Moderation

We reserve the right to review and remove any generated content that violates these Terms or our content guidelines. We may also suspend or terminate accounts that repeatedly generate prohibited content.

Privacy and Data Collection

AI Fruit collects the following types of data:

  • Account Information: Information you provide when creating an account
  • User-Generated Content: Prompts, reference images, and generation settings
  • Generated Content: AI-generated videos and associated metadata
  • Usage Details: Data related to your activity on our service
  • Device Information: Information about the device you use to access our service
  • Cookies: Data that helps us enhance your experience with our service
  • Payment and Billing Information: Data necessary to process payments

Intellectual Property

Third-Party AI Models

AI Fruit uses third-party AI models to generate videos. These models are subject to their own terms of service and usage policies. By using AI Fruit, you agree to comply with the terms of these third-party providers.

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties.

Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, reliability, or availability of the service and disclaim all warranties to the fullest extent permitted by law. We do not guarantee that AI-generated content will meet your specific requirements or expectations.

Limitation of Liability

To the fullest extent permitted by law, HACK THINKING LAB LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the service, including loss of profits, data, or business opportunities. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Indemnification

You agree, to the extent permitted by applicable law, to indemnify and hold harmless HACK THINKING LAB LTD, its affiliates, and their respective officers, directors, employees, and agents from claims, damages, losses, liabilities, and reasonable expenses arising from your unlawful use of the service, your content, or your material violation of these Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Subject to any mandatory consumer-protection rights that apply to you, the courts of England and Wales will have jurisdiction over disputes arising from these Terms or the service.
